Scope

These Terms govern access to and use of our websites and services. By using the Services, you accept these Terms and our policies (Privacy Policy, Cookie Policy, DMCA, Moderation, Refunds).

Accounts and Eligibility

Users/Clients: optional accounts for favourites, alerts and contacting professionals. Minimum age: 18.

Professional Advertisers: only professionals may create advertiser accounts (free) and post listings; paid options include premium visibility, premium translation and off-market listings. We may request documents to verify professional status.

You are responsible for safeguarding your credentials and for all activity under your account. Notify us immediately of any unauthorised use.

Business Model and Services

Freemium model:

• Free professional advertiser account.
• Paid options: premium distribution/visibility, premium translation, off-market listings.
• Off-market: pay-per-listing or unlimited monthly subscription with no commitment.

Translations: listings may be machine- or assisted-translated; the advertiser remains responsible for accuracy. We do not guarantee error-free translations.

Listing Rules and Prohibited Content

Advertisers must ensure listings are accurate, lawful and free of third-party rights (text, images, logos).

Prohibited: illegal goods/services, counterfeits, defamatory or discriminatory content, hate, sexual content involving minors, regulated weapons, illicit drugs, personal data without a legal basis/consent, and any violation of applicable laws.

We may review, refuse, down-rank or remove content at our discretion.

Platform Role and Liability

Royal Sybaris acts as an online intermediary/platform. We are not the owner, seller or provider of the listed goods/services. Transactions take place directly between Users and Advertisers. Advertisers are solely responsible for legal compliance.

Ranking and Sponsored Listings

Ranking factors may include: query relevance, location, freshness, listing quality/completeness, performance (click-through/engagement), availability and commercial factors (sponsorship/paid boosts). Sponsored/paid placements are clearly labelled “Sponsored” or “Ad”.

Payments, Subscriptions and Refunds

Payments are processed by Stripe. Off-market subscription: monthly, no commitment. The satisfaction guarantee applies to the current billing month only. Pay-per-listing purchases are non-refundable once delivered, except for a Royal Sybaris error or a legal obligation.

Intellectual Property

By posting content, Advertisers grant Royal Sybaris a worldwide, non-exclusive, transferable, sub-licensable, royalty-free licence to host, reproduce, translate, adapt, communicate and distribute the content while it is on the platform and for a reasonable archiving period.

Disclaimers and Limitation of Liability

The Services are provided “AS IS” and “AS AVAILABLE”. To the maximum extent permitted by law, Royal Sybaris's total liability is limited to the amounts you paid to Royal Sybaris in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold Royal Sybaris harmless from claims arising out of your use, your content/listings, or your breach of these Terms/third-party rights.

Termination

You may close your account at any time. We may suspend/terminate for violations, legal risk, fraud or in accordance with legal orders.

Governing Law and Dispute Resolution

Governing law: State of Florida, USA. Binding individual arbitration under the Federal Arbitration Act (FAA). Class-action waiver to the extent permitted by law. 30-day withdrawal right from acceptance.

Miscellaneous

Severability, entire agreement, no waiver, assignment. Updates: we may amend these Terms; we will post the updated version and notify where required. In case of discrepancy between translations, the English version prevails unless local law requires otherwise.

Data Collected

• User accounts: basic identity, contact details, preferences, favourites, alerts.
• Professional advertiser accounts: identity, company details, professional verification, listing content, payment/billing metadata.
• Usage data: logs, IP/device identifiers, cookies/SDKs.
• Messaging/interactions: messages between Users and Advertisers.
• Payments: processed by Stripe; we do not store full card data (PSP tokenisation).

Purposes and Legal Bases

• Providing and operating the Services (contract).
• Account creation/management, listing publication and moderation, messaging (contract/legitimate interests).
• Translations and service improvement (legitimate interests).
• Security, prevention of fraud/spam/abuse (legitimate interests).
• Direct marketing/newsletters (legitimate interests/consent depending on jurisdiction).
• Non-essential cookies (consent in the EU/UK).
• Legal compliance (legal obligations and legitimate requests).

Data Sharing

• Service providers: hosting (AWS), payments (Stripe), analytics (Google), translation (Amazon Translate), email delivery, anti-fraud.
• Advertising/partners where applicable (subject to required consents).
• Legal: where required by law, a court order or to protect our rights.

International Transfers

For EEA/UK residents, transfers rely on appropriate safeguards such as the Standard Contractual Clauses (SCCs) and/or the UK IDTA.

Retention

• General retention period: 3 years.
• Accounts: kept while active; then up to 3 years after closure.
• Logs and messages: kept up to 3 years.
• Billing records: per applicable accounting/tax rules.

Your Rights

Depending on your jurisdiction, you may have rights of access, rectification, erasure, restriction, objection and portability. US state privacy rights (e.g. California CPRA): the right to know, delete, correct and opt out of the “sale/sharing” of personal information; we honour the Global Privacy Control (GPC) where applicable.

Security

Technical/organisational measures appropriate to the risk (encryption in transit, access controls, vendor reviews). No system is perfectly secure.

Children

The Services are not intended for persons under 18. We do not knowingly collect data from minors.

Types

• Essential: required for basic operations (authentication, security, preferences).
• Performance/Analytics: audience measurement (e.g. Google).
• Functionality: language/currency preferences, saved searches.
• Advertising/Marketing: targeting, retargeting, attribution (if used).

Consent Management

CMP: Piwik PRO. Manage your choices at any time via the “Cookie settings” link in the footer. We honour your selections and, where applicable, signals such as the GPC.

Takedown Notice

A valid notice must include:

• A physical/electronic signature of the rights holder or their agent.
• Identification of the copyrighted work and of the allegedly infringing material (exact URL(s)).
• The complainant's contact details.
• A good-faith statement and a statement under penalty of perjury that the information is accurate.

Takedown and Counter-Notice

We may remove or disable access to reported material. An advertiser's counter-notice must include: signature, identification of the removed material, a good-faith statement, consent to the jurisdiction of the Federal District Court, and contact details.

Repeat Infringers

Accounts of repeat infringers may be terminated.

Ranking

Results may be influenced by: query relevance, user location, recency/freshness, listing quality/completeness, performance (clicks/engagement), advertiser availability and commercial factors (sponsored placements/paid boosts).

Sponsored Content

Listings or placements that advertisers pay for will be clearly marked “Sponsored” or “Ad”.

Reviews and Ratings

User reviews may influence visibility. Fake or manipulated reviews are prohibited and may be removed.

Off-Market Subscriptions (Professionals)

Monthly renewal, no long-term commitment. Satisfaction guarantee: refunds apply to the current billing month only, on request before the end of the current cycle. No retroactive refunds for previous periods.

Pay-per-Listing Purchases

Premium placements, paid translations and one-off off-market listings are non-refundable once delivered, except in the event of a technical error attributable to Royal Sybaris or where the law requires.

Procedure

Requests: support@royalsybaris.com with account ID, purchase details and reason. Refunds are issued to the original payment method where possible.

Chargebacks

We may dispute unjustified chargebacks and suspend accounts in the event of abuse.

Moderation

We use a combination of automated tools and human review to detect content that is illegal or contrary to our policies.

Reporting

Use the “Report” link on each listing, or email abuse@royalsybaris.com with the URL, description, legal basis (if any) and screenshots.

Decisions and Appeals

We inform advertisers of removals/suspensions with reasons. Appeals may be filed at appeals@royalsybaris.com. We comply with legitimate requests from authorities.

Repeat Violations

Repeated or serious violations, fraud, or legal risks may result in suspension or termination.
