Royal Sybaris is an international platform dedicated to luxury, available at royalsybaris.com (the "Platform"). It allows professionals (real estate agents and agencies, notaries, dealers in cars, yachts and private jets, watchmakers, galleries and other luxury professionals) to present their business and publish listings, and allows visitors to browse those listings, the magazine and the directory of professionals, and to contact the professionals.

These terms of use (the "Terms") set out the rules for accessing and using the Platform that apply to every user. They are accepted when an account is created and, for visitors without an account, by the mere use of the Platform. Paid offers reserved for professionals are also governed by the general sales terms. The processing of personal data is described in the privacy policy.

The Platform is published by Royal Sybaris LLC, a Florida (United States) limited liability company registered with the Florida Division of Corporations, EIN 35-2983352, whose principal office is located at 2125 Biscayne Blvd, Ste 204 #27492, Miami, FL 33137, United States ("Royal Sybaris").

The Platform is hosted by Vercel Inc., 440 N Barranca Ave #4133, Covina, CA 91723, United States. Its database is hosted by Neon and files uploaded to the Platform are stored with Amazon Web Services.

Browsing public listings, the magazine and the directory is open and free of charge, as is sending a contact request to a professional. Some features require an account, in particular favorites, alerts, reviews, publishing listings and contributing to the magazine. Off-market listings and the confidential information attached to them are reserved for authorized professionals.

Connection costs and the equipment needed to access the Platform are borne by the user. Royal Sybaris makes reasonable efforts to keep the Platform continuously available, without any guarantee of result. Access may be interrupted for maintenance, updates or security reasons, or in the event of a technical incident or force majeure, without any right to compensation.

Registration is free of charge and reserved for persons aged at least 18 who have the legal capacity to enter into contracts. Several types of accounts exist: visitor, professional, magazine author and partner (affiliate or distribution). A single account may give access to several of these spaces.

Users provide accurate information and keep it up to date. They confirm their email address through the link sent to them. An account whose address has never been confirmed and which has not been used after registration receives a reminder after 3 days and is then deleted after 7 days.

Login credentials are personal and confidential. Users are responsible for all activity carried out through their account and report any unauthorized use without delay to support@royal-sybaris.com. Two-factor authentication can be enabled from the personal space.

Professional accounts are reserved for persons acting for the purposes of their business. Royal Sybaris may make the publication of listings and access to certain features subject to validation of professional status, based on the information in the profile (in particular registration number, VAT number, address and telephone number) and, where appropriate, supporting documents. Partner accounts are opened by Royal Sybaris for the partners it admits, on the terms agreed with each of them.

Users may request the closure of their account at any time from the "Privacy" section of their personal space or by writing to support.

Users undertake to use the Platform in good faith, in accordance with applicable law and these Terms. The following are prohibited in particular:

• publishing unlawful, misleading, infringing, defamatory, discriminatory or hateful content;
• offering unlawful goods or services;
• collecting or disclosing personal data without a legal basis;
• sending unsolicited messages or messages unrelated to a listing or a professional;
• impersonating another person;
• automated extraction or systematic reuse of the content and data of the Platform;
• any interference with the operation or security of the Platform.

Professionals warrant that their listings and profile are accurate, lawful and up to date. They hold the necessary rights to the texts, photographs and trademarks they publish and, where applicable, the mandates or authorizations required to offer the assets concerned. They remove without delay any listing that is no longer relevant.

Information relating to off-market listings is confidential. Access to their detailed content may be subject to an access request approved by the professional who publishes them and to a confidentiality undertaking (NDA). Users who access such information undertake not to disclose it or use it for any purpose other than assessing the transaction concerned.

A review may only be posted by a user who has had a genuine interaction with the professional concerned through the Platform. It must be sincere and reflect a personal experience. Professionals may dispute a review; Royal Sybaris examines the dispute and may remove a review that breaches these Terms.

Magazine authors are responsible for the articles they submit. Royal Sybaris may refuse or remove an article that breaches these Terms or its editorial line.

The ranking of listings and the identification of sponsored content follow the principles described in the "Advertising & Ranking" section of the legal information.

Any unlawful content or content in breach of these Terms may be reported to abuse@royal-sybaris.com. Royal Sybaris may refuse, downgrade, suspend or remove such content.

Listings and articles may be machine-translated into the languages of the Platform. Professionals and authors also have optional assistance tools: the AI Interview, which prepares a portrait from the professional's written or dictated answers, and the rewriting of texts for search engine optimization. Royal Sybaris may also produce an audio version of magazine articles.

Texts, answers and recordings submitted to these tools are sent, solely for their processing, to technical providers: OpenAI for the AI Interview, voice transcription, rewriting and audio versions; Amazon Web Services (Amazon Translate) for translation.

Content produced by these tools consists of suggestions. Users review it, correct it where necessary and remain solely responsible for what they publish. Royal Sybaris does not guarantee the accuracy of generated or translated content.

The Platform, its structure, texts, visual identity, logos, the Royal Sybaris trademark and its databases belong to Royal Sybaris or its licensors. Any reproduction, representation, extraction or reuse, in whole or in part, without prior written authorization is prohibited.

By publishing content (listing, photograph, profile, article, review), users grant Royal Sybaris a worldwide, non-exclusive, transferable, sublicensable and royalty-free license to host, reproduce, translate, adapt, communicate and distribute that content, on the Platform and through Royal Sybaris distribution partners, for as long as it remains on the Platform and for a reasonable archiving period. Users indemnify Royal Sybaris against any third-party claim relating to that content.

Royal Sybaris acts as an intermediary. It is not the owner, seller or agent of the assets and services presented and is not a party to transactions concluded between users and professionals. Professionals are solely responsible for their listings, their commitments and compliance with the regulations governing their business. Royal Sybaris does not systematically review listings before they go online. Certain listings, identified as such, are an editorial selection of listings published by third parties: contact then takes place on the original website.

The Platform is provided "as is" and "as available". To the extent permitted by applicable law, Royal Sybaris is not liable for indirect damages, for content published by users or for third-party websites to which links point, and its total liability is limited to the amounts paid by the user to Royal Sybaris during the 12 months preceding the claim.

Users indemnify Royal Sybaris against any claim arising from their use of the Platform, their content or their breach of these Terms or of third-party rights.

Nothing in these Terms deprives a user acting as a consumer of the rights granted by the mandatory provisions of the law of their country of residence.

Royal Sybaris processes users' personal data in accordance with its privacy policy, which describes the purposes, legal bases, recipients, retention periods and the rights of individuals. Non-essential trackers are subject to consent, which users can manage at any time through the "Cookie settings" link in the footer.

A professional who receives a user's contact details through the Platform (contact request, off-market access request) processes them under its own responsibility, solely to respond to the request and in compliance with applicable regulations.

Royal Sybaris may suspend or close an account, or remove content, in the event of a breach of these Terms, fraud, legal risk or at the request of a competent authority. Unless there is an emergency or a legal obligation to the contrary, the user is informed of the reasons for the decision and may challenge it at appeals@royal-sybaris.com. Serious or repeated breaches may lead to permanent closure.

Closing an account entails the removal of the published content attached to it, subject to the data retained under the conditions set out in the privacy policy. Ongoing subscriptions are governed by the general sales terms.

Royal Sybaris may amend these Terms, in particular to reflect changes to the Platform or to regulations. The version in force is the one published on this page, with its date of update.

Professionals are informed of changes the next time they log in to the professional space, by a message that links to the amended terms and allows them to confirm that they have read them. Material changes become applicable to them only after a period of 15 days following their publication. Other account holders are informed of material changes by email or by a message on the Platform before they take effect.

Continued use after the new terms take effect constitutes acceptance; users who refuse them may close their account.

These Terms are governed by the laws of the State of Florida (United States). Any dispute relating to their interpretation or performance is submitted, after an attempt at amicable resolution with support, to binding individual arbitration conducted under the Federal Arbitration Act. Class actions are excluded to the extent permitted by law. Users may opt out of the arbitration clause by written notice sent to support@royal-sybaris.com within 30 days of accepting these Terms; disputes then fall within the jurisdiction of the competent courts of the State of Florida.

Users acting as consumers and residing in the European Union or the United Kingdom retain the benefit of the mandatory provisions of the law of their country of residence and may bring proceedings before the courts designated by that law; the arbitration clause applies to them only to the extent permitted by that law. They may also use the alternative dispute resolution methods provided for by that law.

These Terms are drawn up in French, English and Spanish. In the event of any discrepancy, the English version prevails, unless mandatory local law provides otherwise.
